CONDITIONS OF PARTICIPATION
DONAUTAL TRAIL WACHAU
By registering, all participants agree to the terms and conditions of participation and the disclaimer. They undertake to comply with these, to show consideration for other participants and nature, and to promote fair and supportive interaction.
For ease of reading, the term "participant" is used below for all genders.
The organizer of the Donautal Trail Wachau is the association ,Trailwelten – Association for Outdoor Adventure ZVR number: 1740085697
1) Event character
The event is an outdoor hike that starts in Spitz, Weißenkirchen and Dürnstein and ends in Krems. The route runs along hiking trails, gravel roads, cycle paths and public roads on the north side of the Danube in the Wachau region.
The lowest point is in Krems at 197 meters above sea level, the highest point is the Jauerling at 921 meters.
Especially in winter, very different weather, visibility and ground conditions can occur on the route.
For the participants this means in detail:
Safe footing on hiking trails, especially in difficult conditions such as snow, mud or ice.
An awareness of the length of the route as well as the seasonal challenges and the associated physical demands.
Good orientation, especially in areas with limited visibility.
Knowledge of winter-specific equipment and appropriate equipment.
Familiarity with the correct behavior in the event of an emergency in the field.
Responsibility for your own safety at every step.
2) Security
Each participant is responsible for his or her own safety.
Minors may only participate if accompanied by a supervisory person.
The route of the Donautal Trail Wachau is not closed.
Since the trail partially runs along or crosses public roads, the Road Traffic Regulations (StVO) apply. Every participant is obliged to adhere to them and adapt their behavior accordingly.
3) Weather on the day of the event
The participant undertakes to keep an eye on the weather before and during the event and to take independent measures to protect his or her own health, such as leaving the forest in the event of a sudden storm or seeking shelter in the event of hail.
Furthermore, the participant expressly declares that he will not hold the organizer liable for any damage to property or personal injury caused by unexpected weather or natural events and waives any legal action in this regard.
4) Health / physical fitness
The participant is aware of the physical demands. With his signature he confirms that he is physically able to complete the chosen route and declares that he has the necessary fitness for the chosen distance.
5) First Aid
The organizer cooperates closely with the mountain rescue service and the local emergency services. However, due to the nature of the route and the distances, there is no direct medical care along the trail.
In the event of a medical emergency, the affected participant or other participants who notice the incident must independently contact the emergency services on 144 or the European emergency number 112 - as is usual when hiking or in the mountains.
For minor injuries, it is mandatory to carry a first aid kit with a rescue blanket.

7) Withdrawal from registration
A refund of the entry fee is only possible if the cancellation insurance offered was taken out at the time of registration and the corresponding insurance conditions are met.
If properly registered participants do not attend the event for any reason or do not inform the organizer of their absence in advance, they will not be entitled to a refund of the entry fee already paid.
Passing on the starting place is expressly prohibited and will result in disqualification and withdrawal of the starting place. In addition, the person who passes on the starting place unlawfully is fully liable for all damage caused or suffered by the unauthorized participant.
8) Refund in case of event cancellation
If the event has to be cancelled due to force majeure, weather conditions, official orders or an epidemic/pandemic, the participant can, upon request, receive a refund of the entry fee already paid.
However, by registering and/or signing, the participant expressly agrees that the organizer may retain costs that have already been incurred for the event (e.g. expenses for authorities, refreshment stations, personnel) up to the amount of the entry fee and deduct them from the reimbursement amount. In the event of a dispute, the participant must prove that the actual expenditure was less than the amount deducted by the organizer.
If the organizer offers an alternative date in good time (at least 3 days before the event in the event of a change in the legal or weather situation), this shall not be considered a cancellation and the right to a refund of the entry fee shall no longer apply.
The participant also agrees to complete the Donautal Trail Wachau as a “Virtual App Hike” if the event cannot take place on site. This also applies if the participant is unable to attend the alternative date. A virtual event does not constitute a cancellation and the participant expressly agrees to this form.
If the event is cancelled after the start (e.g. due to force majeure or weather conditions), a refund of the entry fee is excluded.
9) Images and privacy policy
The photos and videos taken during the event may be published for press and advertising purposes on television, in print media and in online media. I expressly agree that recordings of me may be made and published for these purposes. I waive any claims regarding image rights during the event and any complaints against the organizer and its partners, including Sportograf.
Any publication or use of images in connection with this event must be done with respect for the event and the registered trademark and requires the consent of the official organizer.
I also agree that my personal data provided during the registration process may be electronically processed and stored by the organizer and TIME2WIN GmbH and used to process my registration and to send emails in connection with the event (e.g. confirmation emails). I also allow the organizer to pass on my data to the company Fürnholzer so that they can sell photos of the participants.
I also agree to receive personalized advertising from the organizer by email. I can revoke this consent at any time without giving reasons by sending an email to info@trailwelten.at.
I am aware that I have the right to information, correction, deletion or restriction of the processing of my data as well as the right to object to data processing and, where provided for by law, the right to data portability. I can also complain to the Austrian Data Protection Authority.
10) Disclaimer
Neither the event organizer, organizer, sponsors, employees, property owners, or trail operators accept responsibility for any damage or injury (including the transmission of disease) suffered or caused by the participant. No liability is accepted towards the participant or third parties.
By registering and/or signing, the participant expressly declares that he/she will not assert any claims against the above-mentioned parties in this context.
The participant undertakes to undergo the organizer's controls and accepts the applicable conditions of participation, which are handed out with the starting documents and can also be viewed on the organizer's website and on site in the start/finish area.
He also confirms that he is participating in the event at his own risk and responsibility.
The participant expressly declares that he is aware of the requirements of the event and is in good health.
11)Schlussbestimmungen
The organizer reserves the right to change the route and the refreshment stations at any time and without prior notice. The participant waives the right to contest this regulation, especially due to errors.
The competent court in Linz/Austria is responsible for all legal disputes. Austrian law applies.
